Shared on Wed, 06/25/2008 - 08:34I have just recently become aware of the Naked Cowboy in Times Square. This guy is borderline nut job, but he does a great interview. He's quick on his feet and has a nice straitman delivery of crazy quirky lines. And to top off my sad little life; he claims to make about $250,000 a year in tips.

Right now he is locked in a legal battle with Mars, the maker of M&Ms, over trademark infringement. The cowboy claims that he spent years developing his image and trademark look and that Mars and their ad agency Chute Gerdeman Inc. have infringed it and made it look as if he is endorsing their product. A judge has stripped away some of the claims of the lawsuit, but has ruled that it is a legitimate case and may move forward.
One wonders why Mars didn't simply offer a payment to the cowboy in exchange for the obvious parody. It could be oversight, but the more plausible explanation is because they have already received far more than 6 million (the amount of the lawsuit) in publicity and free media coverage. If they lose then fine, they pay a little. If they win, then they score a huge win with tons of free ads. Win Win basically.
