I think the real issue may be that he was Pagan, in which case, his rights were violated.
On the BDSM issue, I would be pissed as hell if I was discriminated against for having a fetish for women in plaid skirts and pigtails. I think they should be protected. Wouldn't that fall under the "persuit of happiness" umbrella? (wink and grin)
