Shared on Mon, 05/10/2010 - 08:49So... for those of you following my "get the kids back" saga. I had my second big win of this case. The first was that I was allowed to have a CFI (child family investigator) assigned to the case to review in an objective manner both family situations and decide who was the better parent. (ok it's a little more detailed than that, but that is pretty much what it comes down to).
The 2nd big win was that my ex put in an official objection to changing the hearing date so that the CFI could finish his work, but my objection to her objection won - meaning the hearing date will be changed. I know, it doesn't make sense - but hear me out. When i originally started this quest to get my kids back that was back in 9/09. Yep - justice is SLOOOOWWW in the family court system. I was assigned at that time a hearing date of 5/14. That seemed reasonable because it was so far out. However, in the meantime, I won the argument for having a CFI (win #1), so we need to push the hearing date out - makes sense doesn't it? Not to my ex. She wants to have the hearing before the CFI finishes so that whatever the CFI finds would be irrelevant. AND... here's the REAL reason she doesn't want the hearing to be pushed back to later this summer. My ex has a final hearing on her second (yep. make that 2) DUI. This is the hearing that if she is found guilty, she will do a MINIMUM of 5 days in jail. I'm going to be at that hearing, and if she is found guilty, I'll be there to take the kids. She doesn't want that on the record PRIOR to our final hearing for who should get the kids permanently.
On an interesting side note - in digging up info on my ex, i found out she just filed for bankruptcy. Not a huge deal in this market and how things are going. But here are the specs. She racked up over 80k in debt in 4 years - and that is after making between 4 - 6 thousand (yes, you heard right) per MONTH. Most of that is from me, but she also gets anywhere from 1 to 2k per month from her parents. Did i mention that she doesn't work? She had 75 creditors after her. Only one of them was a hospital for some minor work she had done. The rest was for over spending or not paying her bills or passing bad checks.
bottom line - i think i still have a good shot at getting my kids back - especially with this 2nd big win.
